1. Acceptance of Terms

By purchasing any digital product from Makinlea (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions.

If you do not agree, you must not purchase our products.

2. Business Information

Makinlea is operated as a sole trader in New South Wales, Australia.

All prices are listed in Australian Dollars (AUD).

3. Digital Products

We offer digital products including, but not limited to:

Downloadable planners
Templates
Digital resources
PDF materials

All products are delivered electronically. No physical goods are supplied.

4. Pricing and Payment

All prices are listed in Australian Dollars (AUD).

Makinlea is not currently registered for Goods and Services Tax (GST) in Australia. Accordingly, GST is not included in the listed prices.

Payment is required in full at the time of purchase.

We reserve the right to change prices at any time; however, the price charged will be the price displayed at the time of purchase.

International customers are responsible for any local taxes, duties, currency conversion fees or additional charges imposed by their financial institution or local authorities.

Payments are securely processed through third-party providers.

5. Right to Refuse or Cancel Orders

We reserve the right to refuse, suspend or cancel any order at our discretion, including where we suspect misuse, unauthorised distribution, fraudulent activity or breach of these Terms.

If an order is cancelled prior to delivery, a refund will be issued in accordance with Australian Consumer Law.

6. Digital Delivery

Upon successful payment:

You will receive access to your digital product via email or downloadable link.

It is your responsibility to ensure your email address is entered correctly at checkout.

If you do not receive your product, please contact us at contact@makinlea.com.

7. Refund Policy

Due to the nature of digital products, we do not offer refunds for change of mind once access has been granted.

However, nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.

Under the Australian Consumer Law, our goods come with guarantees that cannot be excluded. If a product fails to meet a consumer guarantee, you may be entitled to a remedy including repair, replacement or refund as required by law.

8. Payment Disputes

If you experience any issue with your purchase, you agree to contact us at contact@makinlea.com to seek resolution before initiating a chargeback or payment dispute.

Initiating a fraudulent or unjustified chargeback may result in immediate suspension or termination of access to our products and may lead to further action where permitted by law.

9. No Guarantee of Results

We make no representations or guarantees regarding any specific outcomes or results from the use of our digital products. Any examples, suggestions or guidance provided are for informational purposes only. Results depend on individual circumstances and use.

10. Intellectual Property and Licence

All content provided by Makinlea, including but not limited to templates, PDFs, designs, graphics, digital materials and branding elements, is protected by Australian and international copyright and intellectual property laws.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the product for personal use only.

Ownership of the product and all associated intellectual property rights remains solely with Makinlea.

You must not:

Reproduce, copy or duplicate the product
Resell or commercially exploit the product
Distribute, share or transfer the product to any third party
Upload the product to any public platform
Modify the product for resale or redistribution

Unauthorised use, reproduction or distribution constitutes a breach of these Terms and may result in termination of your licence and legal action.

11. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect or consequential loss.
Our liability is limited to the amount paid for the relevant product.

Nothing in this clause excludes rights under the Australian Consumer Law.

12. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to technical failures, internet outages, platform disruptions, natural disasters, government actions or other unforeseen circumstances.

13. Email Communications and Marketing

By purchasing from us, you agree to receive transactional emails relating to your order, including confirmations, invoices and access details.

With your consent, we may also send promotional emails about future products, updates and offers.

We comply with the Spam Act 2003 (Cth).

You may unsubscribe from marketing emails at any time by clicking the unsubscribe link included in every email.

14. Privacy

We collect and handle personal information in accordance with the Privacy Act 1988 (Cth).
